  • The Relationship Between Law and Business Ethics: A Comparative Analysis

    One cannot engage in the study of law without considering the relationship it has with the field of ethics. Since both the law and ethics do focus on doing what is right, there are certainly functions of each that are shared. However, as Supreme Court Justice, Potter Stewart, once stated, “Although ethics and law are closely related, they are not the same. Ethical obligations may – and often do – exceed legal duties.”
    In the business sector, decisions are often closely scrutinized as to whether they meet ethical standards even if they are legal. For example, if a company decides to lay off 40% of its workforce to increase profit for shareholders it is certainly considered by many to be unethical. But it is not illegal. Nonetheless, business organizations strive to establish an ethical culture and develop guidelines for sound decisions based on ethics and legal standards.
    In this assignment, you will examine the relationship between the law and business ethics. You will also analyze several ethical theories and determine if using these to make business decisions is practical.
    In your paper,
    Compare and contrast the similarities between the law and ethics.
    Describe three theories of business ethics.
    Discuss the advantages and disadvantages of each in making business decisions.
    Discuss whether ethical outcomes can be truly achieved in making business decisions, given that organizations need to focus on making profits.

In these assignments, you will apply what you have learned in the first weeks of the course to create your own argument.
    The final paper will develop from course readings, your own research, and feedback from classmates and instructor. Your work will be assessed on your ability to follow instructions, clarity of the argument, citation of historical theories, persuasive presentation, grammar, spelling, and punctuation.

    You will write one paper, which makes claims about what you think a person should do who has an ethical dilemma as specified in a case study.     Your reasons explaining your decision should be consistent with a particular ethical theory given in the text and cited below. Your reasons should address why your claim is ethical. Do not include reasons such as, “It would hurt my reputation” or “It would cost me money.” These may seem like compelling reasons to you, but they do not address the question of ethics. 
    What ethical theory supports my claim and why?
    Use one or more of the theories discussed in the text or class that support your claim. Provide citations as required. Citations acknowledge the contributions of others and give your argument more credibility. 
    Qualifications
    Do I acknowledge alternatives, complications, objections, and how do I respond? Careful readers will question your argument, so you should anticipate as many of their questions as you can, and then respond to the most important ones. Provide citations as appropriate. This will give your argument more credibility.
